“Be Tony’s Sidekick” SweepstakesNO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. OPEN ONLY TO LEGAL RESIDENTS OF THE 50 UNITED STATES OR DISTRICT OF COLUMBIA, 18 YEARS OF AGE OR OLDER WHO ARE LICENSED DRIVERS. VOID WHERE PROHIBITED. Employees (and their immediate families (parent, child, spouse or sibling and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related, of T-Mobile USA, Inc. (“Sponsor”) and its parent, affiliates, subsidiaries and advertising and promotion agencies are not eligible to enter or win. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, which are binding and final on matters relating to this sweepstakes. Sweepstakes is subject to all applicable federal, state and local laws.
TO ENTER: Between 12:01 a.m. Eastern Time (“ET”) on July 16, 2008 and 11:59 p.m. ET on August 24, 2008 (the “Entry Period”), there are three (3) ways to enter, 1) Online: visit www.sidekick.com. www.jeep.com, or www.worldofadventuresports.com and follow the directions provided to complete and submit the official entry form. All online entries must be received by 11:59 p.m. ET on August 24, 2008 to be eligible; 2) Onsite: Visit a T-Mobile Sidekick booth or a Jeep booth at participating Boom Boom Huck Jam tour stops (each, an “Event”) and, using the laptop provided, follow the directions provided to complete and submit the official entry form All on-site entries must be received by the specified Event deadline to be eligible; or 3) In-store: Visit the T-Mobile display at participating T-Mobile retail locations on the specified in-store entry date and complete the entry form, available while supplies last, and deposit it in the designated entry box. All in-store entries must be received by close of business on specified in-store entry date to be eligible. For a list of participating Events, please visit www.sidekick.com. For a list of specified in-store entry dates and participating T-Mobile retail locations, please visit www.sidekick.com. Limit one (1) entry per person, per email address and per household, regardless of method entry. Multiple entries received from any one person, e-mail address or household after the first entry received from that person, email address or household will be void. Entries generated by script, macro or other automated or mechanical means are void. All entries become the property of Sponsor and will not be acknowledged or returned.
WINNER SELECTION: A random drawing will be conducted on or about September 2, 2008 to select the potential winner from all eligible entries received by an independent judging agency. Odds of winning depend on the number of eligible entries received. Potential winner will be notified by mail, phone and/or e-mail and required to execute and return an affidavit of eligibility, a liability release and where lawful a publicity release within seven (7) days of date of issuance of notification. If such documents are not returned within the specified time period, prize notification is returned as undeliverable, potential winner is not in compliance with these Official Rules or Sponsor is unable to contact the potential winner within a reasonable time period, prize will be forfeited and an alternate winner selected, at Sponsor’s sole discretion. If winner is at least 18 but still considered a minor, Sponsor reserves the right to award the prize in the name of his/her parent or legal guardian who will be responsible for fulfilling all requirements imposed on winner set forth herein and must accompany winner on trip as his/her guest.
PRIZE: A 3-day, 2-night trip for two (2) to Los Angeles, CA in November 2008 (exact dates to be determined by Sponsor), a 2009 Jeep Wrangler (Estimated Prize Vehicle Manufacturer’s Suggested Retail Price: $34,000) and one (1) Tony Hawk Limited Edition T-Mobile Sidekick for the winner only; wireless service is not included. Trip consists of round trip coach-class air transportation for two (2) from the major U.S. gateway airport nearest winner’s residence (as determined by Sponsor), hotel accommodations (one (1) standard room; double occupancy), a one (1) hour visit at Tony Hawk Inc. in Vista, CA to meet Tony Hawk, admission for two (2) to the Tony Hawk Foundation benefit, Standup for Skateparks in Beverly Hills, CA, ground transportation to/from events, airport and hotel, and a $500 gift card for the winner only. All details of Jeep Wrangler, including color and options, will be determined solely by Sponsor in its sole discretion. Winner must take delivery of vehicle from the dealership designated by Sponsor, or as otherwise instructed by Sponsor. Winner will be required to present a valid U.S. driver’s license, proof of appropriate insurance and cover taxes, title and licensing fees as a condition of receiving vehicle portion of prize. Approximate Retail Value is $38,500. Actual value may vary based on point of departure. Gift card is subject to certain terms and conditions as specified by issuer. If winner resides within a 100-mile radius of destination, Sponsor reserves the right to provide ground transportation in lieu of air transportation and no compensation or substitution will be provided for the difference in prize value. Prize is awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Travel must be taken on dates specified by Sponsor or prize may be forfeited and, at Sponsor’s discretion, awarded to an alternate winner. Travel arrangements must be made through Sponsor’s agent, on a carrier of Sponsor’s choice. Certain travel restrictions may apply. Winner is solely responsible for all expenses, costs or fees associated with acceptance and/or use of the prize not specified herein as being awarded including, without limitation, any and all federal, state and local taxes (including income taxes), title, insurance, license and registration fees. ground transportation, meals, gratuities, and souvenirs. Winner’s guest must be of legal age of majority in his/her state of residence (and at least 18 years of age) and must execute and return a Liability/Publicity Release, unless child or legal ward of winner. If guest is child or legal ward of winner, winner must execute and return all required documents on behalf of such child or legal ward. Winner and guest must travel together on the same itinerary and are responsible for obtaining all necessary travel documents. Sponsor does not guarantee the opportunity to meet Tony Hawk. Winner and guest must comply with venue, event and meet and greet rules and regulations. Failure to do so may result in forfeiture of such portion(s) of prize. In the event Sponsor is unable to provide meet and greet with Tony Hawk or admission to any event, no compensation or substitution will be provided in lieu thereof; however, remainder of prize package will be awarded and Sponsor will have no further obligation to such winner. Winner may not substitute, assign or transfer prize or redeem prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute prize (or portion thereof) with one of comparable or greater value. All prize details are at Sponsor’s sole discretion.
GENERAL CONDITIONS: Released Parties (as defined below) are not responsible for lost, late, incomplete, stolen, inaccurate, misdirected, delayed, illegible, undelivered or garbled entries or lost or stolen entry boxes; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, printing, typographical, mechanical, telephonic, electronic or network relating to or in connection with this sweepstakes, including, without limitation, errors which may occur in connection with the administration of the sweepstakes, the processing of entries, the announcement of the prize or the cancellation or postponement of any Event. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the sweepstakes. Released Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this sweepstakes or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the sweepstakes or website or who are otherwise in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Should any portion of the sweepstakes be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the sweepstakes and, if terminated, select the potential winner from all eligible, non-suspect entries received prior to action taken. Entrants, by participating, agree that Sponsor and parent, affiliates, subsidiaries and advertising and promotion agencies and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize (including any travel or activity associated thereto or any harm or injury resulting from use of the vehicle) or participation in this sweepstakes. Winner, by acceptance of prize, except where legally prohibited, grants permission for Sponsor and its designees to use his/her name, address (city and state), photograph, voice and/or other likeness and prize information for advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide, and on the Internet and world wide web, in perpetuity, without notice or review or approval. In the event of a dispute regarding online entries received from multiple users having the same e-mail account, the authorized subscriber of the e-mail account at the time of entry will be deemed to be the entrant and must comply with these Official Rules. Authorized account subscriber is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), online service provider, or other organization responsible for assigning e-mail addresses.
WINNER’S NAME: For the name of the winner (available after September 3, 2008, send a self-addressed stamped envelope to: “Be Tony’s Sidekick” Sweepstakes Winner, C/O BNC, 8687 Melrose Avenue, Los Angeles, CA 90069 by September 10, 2008.
